1. The agreement

AWA-099 ("the app") is made and published by AYA MIM S.R.L., a limited liability company registered in Romania, operating the AWA48 brand ("we", "us"). By installing or using the app you agree to these terms. If you downloaded the app from the App Store, Apple's Media Services terms also apply; from Google Play, Google's terms of service also apply.

2. What the app is

AWA-099 is an educational quiz: illustrated subjects, multiple choice questions and short facts, for entertainment and casual learning. It is not a reference work, not a medical, veterinary or botanical resource, and not a field guide.

3. Subscription, trial and billing

  • The app requires an auto-renewing yearly subscription ($9.99 per year, or the equivalent shown by the store in your currency; prices can vary by region and can change for future renewal periods with notice).
  • New subscribers get a 7-day free trial. The subscription starts, and the yearly price is charged, when the trial ends, unless you cancel at least 24 hours before.
  • Billing is handled entirely by Apple or Google against your store account. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel the subscription at any time in your App Store or Google Play subscription settings. Cancelling stops the next renewal; it does not refund the current period.
  • Refunds are handled by Apple or Google under their own policies; we cannot issue store refunds ourselves.

4. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own, for as long as your subscription is active. You may not copy, redistribute, sell, reverse-engineer or extract the app or its content, except where the law expressly permits it.

5. Content and ownership

The illustrations, facts, design and name of the app belong to AYA MIM S.R.L. The share cards the app produces are for personal, non-commercial sharing. Wikipedia articles the app links to belong to their authors under their own licences.

6. Not a field guide

The app's pictures are illustrations, not photographs of real specimens. Some collections include species that can hurt or kill you, marked TOXIC or DEADLY; an unmarked subject carries no claim of safety whatsoever. You must never eat, pick, touch or otherwise rely on anything in the real world on the strength of this app, and never use it to identify a real specimen. Identification of real specimens is a job for a qualified expert. To the maximum extent permitted by law, we accept no liability for any harm arising from using the app as a field guide, which it is not.

7. Accuracy

Facts in the app are researched and written with care, but they are provided "as is", for curiosity and learning. We do not warrant that any fact is complete, current or error-free.

8. Warranty and liability

The app is provided "as is" and "as available", without warranties of any kind beyond those the law requires. To the maximum extent permitted by law, our total liability arising from the app is limited to the amount you paid for your current subscription period. Nothing in these terms limits liability that cannot be limited by law, or the mandatory consumer rights of your country of residence.

9. Termination

You can stop using the app at any time; deleting it removes all local data. We may terminate or suspend access if you materially breach these terms. Sections 5 through 8 survive termination.

10. Changes

We may update these terms; the date at the top changes when we do. A material change will be announced in the app or on this site before it applies. Continuing to use the app after a change takes effect means you accept the updated terms.

11. Governing law, language and contact

These terms are governed by the laws of Romania, without prejudice to the mandatory consumer protections of your country of residence. EU consumers may also use the European Commission's online dispute resolution platform. These terms are drafted in English; translations are provided for convenience, and the English version prevails if they differ.
